Facundo Chavez Handed a Death Penalty Over Capital Murder Charges

An American court in the County of El Paso, Texas, on Wednesday, handed a death sentence to a man convicted of murdering Sheriff Deputy Peter Herrera in 2019.

Facundo Chavez was sentenced to death after admitting to firing 15 shots at the traffic cop and deserting him to his fate on March 22, 2019, at around 1:50 a.m., in the 1000 block of Chicken Ranch Road, San Elizario area.

“I shot Deputy Herrera. I beat him with a gun,” Chavez testified twice in his trials, as the prosecution showed footage of Herrera laying in his pool of blood to the jury of nine women and three men who heard the case.

The 32-year-old Chavez was with his girlfriend, Arlene Piña, when Herrera flagged his car for traffic violations, failing to dim high-beam headlights and improperly displaying a temporary license plate permit. It is then that he stopped, got out of the car, pulled the handgun, and shot at the officer, who was taken to Del Sol Medical Center for critical care but succumbed after two days.

The couple fled the scene but was arrested days later in their hideout by US Border Patrol agents. After several court hearings, Piña was subject to charges of capital murder but got a plea deal with El Paso District Attorney Yvonne Rosales, reducing the leveled offense to manslaughter. She is currently serving a 15-year prison sentence.

Now, the panel of judges led by Judge Diane Navarrete found Chavez guilty of capital murder on August 3. And in a deliberation that took nearly 10 hours of two days, he will be put to death, but the execution date is not yet announced.

Chavez had no visible reaction when Judge Navarrete read the verdict.

Does MoKash have application fees? No, but when you apply for the loan, a 9% origination fee is charged before the money is disbursed. If you fail to make its repayment within a month, your repayment term will be extended for another 30 days but with a 9% extension fee.

What Is the Malabo Protocol That President William Ruto Signed? 5 Things to Know

What is Malabo Protocol?

On July 24, 2023, President William Ruto signed the Malabo Protocol, an instrument of ratification that will clip the wings of the International Criminal Court’s Rome Statute by limiting the jurisdiction of the permanent international court over matters relating to Africa and its heads of state and governments, meaning its a matter of time before the ICC can only hear cases authorized by the African Union (AU).

The Malabo Protocol will break the ICC’s regulatory and oversight orbit by placing the African Presidents and senior government officials beyond the judicial direction as it seeks to create a more agile African Court of Justice and Human Rights (ACJHR) which will try transnational crimes and cases under international law such as genocide, crimes against humanity, war crimes, the crime of unconstitutional change of government, piracy, terrorism, coups, corruption, money laundering, human trafficking, illegal drug trade, illegal waste trafficking, illicit exploitation of natural resources, and the crime against peace.

Here are the five things you need to know about the Malabo Protocol:

1. The Malabo Protocol did not begin yesterday

The conversations that brought about the birth of the Malabo Protocol did not begin recently, but in the 1980s, when African leaders had a sitting to draft the African Charter on Human and Peoples’ Rights (now African Charter) in which Article 1 created the African Court on Human and Peoples’ Rights on January 25, 2004, after the heads of African countries agreed to ratify the court’s legal framework in their 34th Ordinary Session at Ouagadougou, Burkina Faso, in 1998.

2. Former Nigerian President Olusegun Obasanjo is the major playmaker – history of Malabo Protocol

The former President of Nigeria, Olusegun Obasanjo, who was central in the recent peace talks between President Ruto and former Prime Minister Raila Odinga concerning demonstrations in Kenya, is a major playmaker in the Malabo Protocol. In 2004, when Obasanjo was the Chair of AU, the African member-only political and economic union had already passed the Protocol of the Court of Justice of the African Union and the Protocol to the African Charter on the Establishment of an African Court on Human and Peoples’ Rights was already in force.

Initially, the African Human Rights Court was to execute its mandate as a standalone court, but the Nigerian ex-President proposed a merger saying, “Why shouldn’t the Court of Justice take along with it the Court on Human and Peoples’ Rights so that we have a Court of Justice which will have a division, if you like, for border issues, a division for human rights issues, a division for cross-border criminal issues or whatever.”

This gesture received condemnation and callouts from several human rights organizations, like Amnesty International and other whistleblowers, with arguments that the split would hinder the operations of the good plan of protecting human rights, but despite that, the AU established the Protocol on the Statute of the African Court of Justice and Human Rights in 2008 and assigned Pan African Lawyers Union (PALU) to work out the legal instrument in 2010. The draft Protocol was ready by 2011 and was reviewed in 2012.

However, the AU said, “The drafting process was rushed and very complex, lacked transparency, and full participation from the range of actors and stakeholders,” thus, it was not adopted.

3. Uhuru-Ruto ICC case brought Malabo Protocol

By 2012, the African Human Rights Court was already functioning but could not entangle with the African Court of Justice and Human Rights (ACJHR) because it was still premature – the draft Protocol had not been passed yet. The AU Commission and the African Human Rights Court were bound to make the necessary changes after their 19th Ordinary Session of the AU Assembly in July of that year.

The two bodies retreated to come up with answers to big questions raised during the Assembly, among them being to propose a definition of the crime of unconstitutional change of government and in a meeting held in December of 2012 in Arusha, its interpretation was, “Where the Peace and Security Council of the African Union determines that the change of government through popular uprising is not an unconstitutional change of government, the Court shall not be seized of the matter.”

The African leaders also discussed the financial costs of running ACJHR and partly instituted the Protocol. The question of its jurisdiction was still pending. It was now 2013. The AU Commission appointed the AU’s Peace and Security Council (PSC) as a partner in eliminating the deterrents in the draft statute of expanding the jurisdiction of the ACJHR.

In October 2013, Retired President Uhuru Kenyatta and President William Ruto were seeking a term as President and Deputy President, respectively, but were indicted in crimes against humanity following the 2007/2008 post-election violence and were standing trial at the ICC in the Hague, Netherlands.

The duo sought help from AU to stop the legal processes at ICC, which was successful, and were cleared to run for the Executive seats after the pressed charges were thrown out. It was after these happenings that the AU decided to override the ICC by rapidly instituting the Malabo Protocol, which grants immunity to all heads of state or presidents in Africa and undefined senior officials.

The Malabo Protocol or the Amended ACJHR Statute got validated in the 23rd Ordinary Session of the AU at Malabo, Equatorial Guinea, in June 2014.

4. Kenya is among the funders of ACJHR – over Ksh100 million

Despite its economic struggles at home, Kenya is offering to give $1 million to the African Court of Justice and Human Rights (ACJHR) to boost its justice initiatives when the court starts operating after the required number of countries ratify the Malabo Protocol.

According to projected operation costs, ACJHR will have 211 staff, consisting of 16 judges drawn from different AU states, and will work with an annual budget of $4,422,530.

5. Kenya is the 16th country to sign Malabo Protocol

After President William Ruto put his name and signature on the Malabo Protocol, it made Kenya the 16th country to give the first green light to the controversial Protocol after the Central African Republic (CAR) accepted it on July 19, 2023.

According to the African Parliament of the AU, before the Malabo Protocol becomes binding, a country must sign, which is the first step completed by Kenya, ratify, and finally deposit the instruments (in the Kenyan case, the pledged $1 million) at the African Union Commission.

Which countries have ratified the Malabo Protocol? Ratification simply means to be accepted under a country’s internal laws or constitution. As of 2023, 15 African countries have ratified the Protocol by completing the stated steps; signing, ratifying, and depositing the instruments.

Kenya will soon join the list as the country number 16 to ratify the Malabo Protocol, banking on President Ruto’s speech at the 3rd Pan-African Parliament’s Summit held in Midrand, South Africa, where he said: “PAP provides a fundamental deliberative forum where the peoples of Africa gather to reason exhaustively together and develop African Solutions to Africa’s Problems” and promised to ratify the Protocol by September 2023.

How Much Does MTN Mobile Money Transactions Cost in Uganda?

Like any other financial service, MTN Mobile Money, or simply MoMo, of the largest telecom operator in Uganda, MTN Uganda Limited does charge fees when sending, receiving, or withdrawing money to facilitate the transfer to recoup operating expenses and make a profit.

In fact, in their latest half-year unaudited financial performance data released at the end of June 2023, MTN Mobile Money was among the highest revenue generators of the telecommunication firm after it grew by 18.6% to record 10.9 million MoMo customers who transacted Ush61.6 trillion within the period in consideration.

In the fiscal report that covered the first and second quarters evaluation, MTN Mobile Money accounted for 28.7% of the reported revenue, up from 27.8% in the first half of 2022, a big percentage of it coming from monies charged as transaction fees.

KUCCPS: Changing or Leaving Your Course, University in Kenya (2023)

How to transfer universities and courses on KUCCPS student portal 2023

The state educational agency that helps Kenyan students gain admission into various universities, Kenya Universities and Colleges Central Placement Board (KUCCPS), has said that it is welcoming applications from incoming freshmen who have been called up to study at various institutions but dislike either the university or the endorsed degree or program of study.

Following this notice, the 2022 KCSE students, who will join universities and colleges in the upcoming 2023/2024 semester in September, can now make online KUCCPS Inter-Institutional Transfer Applications. However, “one will only be able to apply to transfer to a course whose minimum requirements one meets,” as per KUCCPS.

Meaning, only those that meet the cut-off points of the programs they want to switch to can do so before the KUCCPS transfer window closes on August 15. The cost of changing universities and courses is Ksh1,000, payable during the course transfer process on the Mpesa popup or via Mpesa Pay Bill number 820201. Do not pay in advance.

There are many reasons why one may consider switching institutions or programs of study; the main ones being when the degree doesn’t meet the current industry demands, the proximity of the education facility and their homes, or just lack of self-motivation, which is a core as ignoring your true calling will only fill you with dread and despair.

Also, some opt for other faculties due to the expensive fees or academic rigor associated with some courses and universities, when supposedly, the higher you go, the cooler it becomes. So how can you change courses or universities in Kenya?

How to transfer universities and courses on KUCCPS student portal

Inter-university and course transfer can only be done online on the KUCCPS portal solely by the student. Follow these steps to do it;

1. Visit students.kuccps.net
2. Enter your KCSE index number, year, and birth certificate or KCPE index number as your password to log in
3. On the KUCCPS students’ portal homepage, go to the ‘Transfers’ tab to access the list of courses that you are eligible to switch to
4. After selecting the course you would wish to transfer to, the KUCCPS algorithm will automatically check if you meet the required cut-off points to pursue it and provide you with a list of institutions offering that program of study
5. Choose a university that you would like to pursue the desired course
6. Give a brief reason why you are shifting courses and institutions
7. Pay Ksh1,000 KUCCPS course-university nonrefundable transfer fees
8. Submit your application

After completing this process, you will receive a message from KUCCPS that your inter-institutional transfer application was successful. The new university you are seeking admission to will get your request, communicate with the initial institution that you were to attend and process a transfer letter which will be approved and issued by KUCCPS before the start of the new academic year.

What Is Xlsx File? How to Open and Use It

An Xlsx is a file with a .xlsx extension introduced by Microsoft Excel in 2007 as a replacement for XLS or MS-XLS file format that was in use in Microsoft Office 2003 and could not support the latest functionalities of Excel applications of Microsoft spreadsheet editors.

The technical documentation of the XLS file was Binary Interchange File Format (BIFF), but after the shift to Xlsx, it changed to BIFF8, which uses powerful markup languages for structured data management.

Xlsx files on Microsoft Excel worksheets are zipped files or Open XML File Formats (OOXML produced in SpreadsheetML and other Extensible Markup Language (XML), whereby; zipping means compressing several files to a shareable, accessible, and interpretable single archive file.

If you need to open Xlsx files on your mobile phone, here is the easiest way of doing it. We’ll look at how to open files with .xlsx extensions on an Android device;

1. On your Android mobile phone, go to Google Play and download and install Xlsx viewer: read XLS
2. Click on the application to make it ready for use
3. Allow Xlsx Reader app permission to access your phone storage

This is just a simple way of reading Xlsx files on mobile phones. However, we chose Xlsx Reader because of its small-sized storage feature: it cannot consume your data if you are on mobile data.

Operating without Microsoft programs on your computer or laptop can be very challenging because you cannot open many documents just by clicking on them, and you have to look for specific programs to run them.

Xlsx files are one of the documents that you will not open instantly with a click when you lack Excel. So how can you open Xlsx files on your laptop and computer without Microsoft Excel?

1. Visit docs.google.com/spreadsheets
2. Ensure you have signed in first with your Google Account. Click ‘Blank’ workbook
3. On the top menu bar, click on ‘File’
4. Choose ‘Open’ then ‘Upload’
5. Browse the Xlsx file on your laptop or PC storage
6. Select the Xlsx file for upload on Google Sheets
7. Your Xlsx file is now open for interpretation

Alternatively, opening Xlsx files online is possible through a variety of websites like Open XLSX Online for Free – Aspose Products, View XLSX online | Free GroupDocs Apps, Excel viewer online, and many others, but with a majority of them, you cannot edit or copy data, and this can be inefficient.

Copyright is a legal expression that describes the rights given to creators of literary and artistic works for the benefit of recognition, identification, and protection against redistribution and illegal use by other people. When you have a copyright, anyone seeking to use your work must seek your permission first.

In Uganda, the Copyright and Neighbouring Rights Regulations, 2010 governs copyright, and the government issues these exclusive rights to original authors or the creators through the Uganda Registration Services Bureau (URSB), a statutory body that also registers patents for protecting original inventions.

The copyright law in Uganda classifies ‘works’ as performing arts like music, scripts, lyrics, and recordings, visual arts such as architecture and sculptures, motion pictures like films and movies, photographs, and other digital content, for example, computer programs and expressive creations in blogs, books, and newspapers. What is the procedure for the Registration of Copyright?

How to get a copyright in Uganda

As a content creator, it is wise to get your work copyrighted to profit from its derivatives when it gets republished or used by consumers.

As stated earlier, URSB performs copyright registration in UG. Follow these steps to apply;

1. Download Form 1 – APPLICATION FOR REGISTRATION OF COPYRIGHT OR NEIGHBOURING RIGHTS
2. In the first three sections of the application form, give the title, description, and name of the creator of the work you want to copyright
3. In part four, provide your contact information; email, postal address, and phone number
4. State the crucial dates in the creation of the work, that is, the date of creation and publication
5. Complete the form with other relevant information and put your sign at the signature line together with the date of application
6. When the form is duly filled, pay the Ush50,000 copyright application fee to URSB and get the receipt
7. Combine the filled Form 1, the receipt of payment, and copies or records representing the work for which is to be registered for copyright for purposes of verification and send it to;

When the URSB Copyright Registrar receives your application and is satisfied that all the requirements have been met, a notice of application will be published in the Uganda Gazette for general public information so that anyone with an objection against the submitted work can file a complaint.

If no issue arises regarding your copyright application after sixty days from the date of publication in the Gazette, the Copyright Registrar will list you in the URSB database as the rightful owner of the work, and you will be given a certificate of registration as proof of registration.
