The Finance Bill 2023 Kenya

The Finance Bill 2023 Kenya

The Finance Bill 2023 in Kenya aims to introduce amendments to various tax and duty-related laws with the objective of increasing government revenue through taxation. The bill is currently being reviewed by the National Assembly, and it encompasses several key changes that are worth noting:

  1. Income Tax:
    • The turnover tax (TOT) rate is proposed to be increased from one to three percent.
    • Micro-businesses with a turnover of at least KES 500,000 annually (previously KES 1,000,000) will be included in the tax net.
    • Businesses with turnovers above KES 15 million will be subject to income tax at a rate of 30 percent.
  2. Digital Assets Tax:
    • A three percent levy on transfer charges will be introduced for digital assets such as cryptocurrencies, digital currencies, and non-fungible tokens (NFTs).
  3. Taxation of Member Clubs:
    • Member-based clubs or trade associations will now be subject to tax on their business income, excluding joining fees, welfare contributions, and subscriptions.
  4. Withholding Tax for Digital Content Creators:
    • Fifteen percent of payments made to digital content creators will be withheld as withholding tax.
  5. New Tax Band for High-Income Earners:
    • A new pay-as-you-earn tax band of 35 percent will be introduced for individuals with a gross monthly income above KES 500,000 or KES 6 million annually.
  6. 3% Housing Levy Deductions:
    • A new statutory deduction of three percent of gross earnings will be introduced into the National Housing Development Fund.
  7. Value-Added Tax (VAT):
    • VAT on petroleum products is proposed to be increased from eight percent to 16 percent.
    • Imported digital service providers will be required to register for VAT, removing the previous turnover threshold of KES 5 million.
    • VAT exemptions will be granted for diagnostic and laboratory reagents, vaccines for human and veterinary medicine, aircraft and spacecraft parts.
  8. Excise Duty:
    • Timely excise duty payments will be required for certain industries, such as gaming, within 24 hours.
    • Excise duty will be introduced on cosmetics, including human hair, wigs, false beards, eyebrows, eyelashes, and artificial nails, at a rate of five percent.
    • Increased excise duty rates will apply to mobile money transfer services, gaming, betting, price competitions, and lotteries.
  9. Tax Appeals Tribunal:
    • Taxpayers challenging decisions of the Tax Appeals Tribunal will be required to deposit 20% of the disputed tax amount at the Kenya Revenue Authority (KRA) or provide equivalent security before proceeding to the High Court.
  10. Tax Procedures Act:
  • The KRA will no longer grant relief due to doubt or difficulty in tax recovery, potentially leading to a more assertive tax authority.
  1. Miscellaneous Fees & Levies Act:
  • The import declaration fee is proposed to be revised from 3.5 percent to 2.5 percent.
  • The Railway Development Levy (RDL) is proposed to be reduced from 3.5 percent to 2.5 percent.

The Housing Levy Tax in Kenya is a contribution scheme introduced by the Kenyan government to facilitate the provision of affordable housing for its citizens. It is part of the government’s efforts to achieve its Big Four Agenda, which includes the delivery of 500,000 affordable homes by 2022.

Starting from May, the government has directed all employers to deduct 1.5 percent of their employees’ monthly income to contribute to the housing levy. This contribution should not exceed KES 5,000 for both employers and workers. Non-citizens and those in informal employment are required to contribute approximately KES 200 per month.

The primary aim of the housing levy is to generate funds, estimated to be around KES 57 billion annually, from the 2.5 million salaried Kenyans. This will attract local and international developers to participate in the construction of one million affordable housing units. The project is expected to expand to other regions as well.

Contributors to the housing levy will enjoy several benefits. Individuals earning above KES 100,000 will be eligible for a refund of their contributions plus interest after 15 years. These savings can also be used as collateral when seeking a mortgage. For those earning below KES 50,000, housing will be provided through the tenant purchase scheme. Individuals earning above KES 50,000 will qualify for a seven percent mortgage payable within 15 years.

Other advantages of the housing levy include the opportunity for individuals to purchase a home under an affordable housing scheme. In cases where a person does not acquire a house, their contributions will be transferred to a pension scheme.

It is important to note that employers are required to deduct and remit the housing levy along with other payroll statutory deductions. Failure to comply with this directive may result in penalties for non-compliance. Contributors who do not acquire a house will receive a refund of their contributions after retirement.

The implementation of the housing levy aims to address the critical issue of affordable housing in Kenya and provide citizens with opportunities to own their own homes.

Places to visit in Nairobi The Karen Blixen Museum

The Karen Blixen Museum is located 19 km outside Nairobi at the foot of the Ngong Hills. It consists of a beautiful farmhouse and grounds which offer a wonderful scenic view and the tour involves some interesting stories about the original occupants of the estate and features rooms designed in both the original decor and with props from the ‘Out of Africa’ film.

The museum stands on a farm that was originally owned by a Danish couple, Karen Blixen and her husband, Baron Bror von Blixen-Finecke who had acquired it in 1917. The bungalow-style house had been built, in 1912, by a Swedish engineer Åke Sjögren.

The couple’s original plan was to operate a coffee plantation on the land. It was a 6,000-acre farm, of which 600 acres were used for coffee farming. Karen and the Baron separated in 1921 and the running of the farm was left to Karen. Karen continued to run the farm until 1931 when she went back to Denmark
due to various reasons, among them, the death of an English man, Denis Finch Hatton, with whom she had fallen in love with, Tsavo in 1930 and the failed farming.

Back in Denmark, Karen took up writing and some of her works include Seven Gothic Tales (1934), Out of Africa (1937), and Babette Feat (1950). Her books ‘Out of Africa’ and ‘Shadow on the Grass’ chronicle her life here in Kenya.
The house was occupied by different people until it was purchased by the Danish government in 1964 and given to the Kenyan government as an independence gift. The Kenyan government set up a college of nutrition and the house was used as the principal’s house.

In 1985 the movie Out of Africa was released and an agreement was reached with the college to turn over the ownership to the National Museums of Kenya. Pieces of furniture that Karen Blixen had sold to Lady McMillan on her departure was acquired back and constituted part of the exhibition in the
Museum.
